Terms and conditions

Draft for approval. Last updated 20 October 2026.

These terms apply to everyone who uses Fondly Remembered. Part 1 applies to everyone. Part 2 applies to funeral directors with an account. Part 3 applies to people who post a single notice themselves. Please read the parts that apply to you.

Fondly Remembered is run by Fondly Remembered Ltd, registered in England and Wales [company number to be added], of Unit 15 Scottow Enterprise Park, Lamas Road, Scottow, Norfolk, NR10 5FB ("we", "us"). You can contact us at any time.

Part 1: Everyone

Using the site

You can read notices and search the site free of charge. Please use it with the care and respect that a place of remembrance deserves.

Messages in a book of condolence

When you leave a message you agree that:

  • it is your own words, and true to the best of your knowledge;
  • it is respectful, and does not contain anything abusive, hateful, threatening, obscene, unlawful or private information about someone else;
  • it is not advertising or spam;
  • we may show it on the notice, together with the name you give, for as long as the notice is published.

We may hold back, edit to remove personal details, or remove any message that does not follow these terms, and we may block anyone who repeatedly breaks them. You can ask us to remove your own message at any time.

Reporting a problem

If a notice or message is wrong, upsetting or should not be there, please use the "Report a problem" link on it. We aim to review every report within 72 hours. If a notice is reported as false, we may hide it straight away while we check it.

What we are responsible for

We take care to publish notices accurately, but notices are written by funeral directors and families, and we cannot check every detail. Please confirm funeral arrangements with the funeral director or family if they matter to you, for example before travelling.

We are not responsible for websites we link to, such as charity donation pages.

Nothing in these terms limits our liability where the law does not allow it to be limited, including for death or personal injury caused by our negligence, or for fraud. Otherwise, we are not liable for losses that were not reasonably foreseeable, or for business losses to visitors.

Our content

The design and text of the site belong to us. Notices and messages belong to the people who wrote them. Please do not copy notices in bulk or use automated tools to collect them.

Part 2: Funeral directors

Your account

To publish notices you need an account for your business, and we must verify your business before your notices appear. You must give us accurate details, keep them up to date, and keep your sign-in details and two-step sign-in device secure. You are responsible for what anyone you invite onto your account does with it.

Publishing notices

You may publish only notices that you are arranging, or have arranged, the funeral for, with the agreement of the family. You confirm that each notice is accurate and that you have the right to publish its words and photographs. You will correct or remove a notice promptly if the family asks or if it is wrong.

Notices are permanent pages unless removed. We may hide or remove a notice that breaks these terms, is reported as false, or that we must remove by law, and we will tell you if we do.

Plans and payment

Your plan, its prices and what it includes are shown when you choose it and in your dashboard. Prices are in pounds and exclude VAT, which is added at the current rate. Plans renew automatically at the end of each billing period until cancelled. You can cancel at any time, effective at the end of the period you have paid for; we do not refund part periods [client to confirm]. If a payment fails we will tell you, and if it is not made we may pause publishing until it is.

On monthly plans, notices beyond your plan's allowance are still published, and are charged as extra posts at the price shown for your plan.

We may change our prices or plans by giving you at least [30] days' notice by email. If you do not agree, you can cancel before the change takes effect.

Your page

Your business has a page on Fondly Remembered with the details you choose to show. You are responsible for those details being accurate and lawful.

Ending your account

You can close your account at any time. We may suspend or close an account that breaks these terms, after telling you why where we can. When an account closes, the notices already published stay published unless you or the family ask for them to be removed.

Part 3: Posting a single notice

[This service opens after launch; the client to confirm details and price.]

You can post a single funeral notice for a fee shown before you pay. We check every notice before it is published, which may include confirming the details with the funeral director. Your card is authorised when you submit the notice and charged only if we publish it. If we cannot publish it, the authorisation is released and you are not charged.

You confirm that you are entitled to publish the notice, that it is accurate, and that you have the family's agreement.

As a consumer you normally have 14 days to cancel a service. By asking us to publish your notice straight away once it is approved, you agree that you lose that right once it is published. Before it is published you can cancel and you will not be charged.

Changes to these terms

We may update these terms. We will publish the new version here with the date it changed, and tell funeral directors with accounts by email before significant changes take effect.

Law

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
